29 CFR 1926.451(e)(8): Direct access to or from another surface was used when the scaffold was more than 14 inches (36 cm) horizontally and/or 24 inches (61 cm) vertically from the other surface:    a) 5th floor telephone room - employee was transitioning from a duct to a mobile scaffold and fell 10 feet to the floor below; on or about 8/19/13.     Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.452(w)(2): Scaffold casters and wheels were not locked with positive wheel and/or wheel and swivel locks, or equivalent means, to prevent movement of the scaffold while the scaffold was used in a stationary manner:    a) 5th floor telephone room - mobile scaffold moved when an employee was transitioning from working on top of a duct to the scaffold surface and fell approximately 10 feet to the floor below; on or about 8/19/13.     Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
