29 CFR 1915.73(d): When employees were exposed to unguarded edges of decks, platforms, flats, or similar flat surfaces, more than 5 feet above a solid surface, the edges were not guarded by adequate guardrails meeting the requirements of 29 CFR 1915.71(j)(1) and (2): (a) The RMG 1000 barge located in the slip: On August 19, 2013 and at times prior to; the employer failed to provide guard rails on all sides of the barge, exposing to falls of approximately 12 feet into the water and to the edge of the slip.

29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: (a) Facility wide: On August 19, 2013 and at times prior to; the emploiyer failed to ensure that industrial trucks that were found not to be in a safe operating condition, were not removed from service exposing employees to crushing hazards in that the seat belt had been removed and not replaced.
