Violation observed on or about 8/20/2013.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: a) Work Site: 3 Kearny Avenue, Kearny, NJ Employees working inside an excavation measured to be approximately 8 to 9 feet in depth were not provided with an adequate protective system, designed for use and approved by a certified professional engineer, and were thereby exposed to cave-in hazards. Violation observed on or about 8/20/2013. Reivax Contracting Corp. was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA Inspection Number 316229582, Citation 1, Item 2, issued on 2/9/2013, and affirmed as a final order on 3/1/2012, with respect to a workplace located at Radley Street and Schuyler Avenue in Kearny, NJ.
