29 CFR 1926.454(c): Scaffold fall protection training: Retraining was not provided when the employer has reason to believe the employee lacks the skill or understanding needed for safe work involving the erection, use or dismantling of scaffolds: a) Employees were not preparing the jobsite for use of fall protection; lifelines were not installed and used when feasible when employees are erecting/ dismantling scaffolds. Employees were exposed to 150 ft fall hazard standing on the uppermost (two) planks when installing a stair tower. Location: 14 Wall St, New York, N.Y. On or about 8/20/2013 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(2): The employer did not have a competent person determine the feasibility and safety of providing fall protection for employees erecting or dismantling supported scaffolds. Employers are required to provide fall protection for employees erecting or dismantling supported scaffolds where the installation and use of such fall protection is feasible and does not create a greater hazard: Location: 14 Wall St, New York, N.Y. On or about 8/20/2013 a) Employees were exposed to 150 ft fall hazard standing on the uppermost (two) planks, when erecting a scaffold stair tower. Fall protection lifelines were feasible but were not provided. Repeat violation The employer Spring Scaffolding was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(2), which was contained in OSHA inspection number 315551291, citation number 1, item number 3 and was affirmed as a final order on 9/10/2011, with respect to a workplace located at 60 W 23rd St, NY, NY. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.
