29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) 3rd Floor - Workers were installing a sprinkler system near an unguarded window opening with its ledge 23 inches above the floor surface without wearing fall protection and were exposed to a 26 feet 2 ½ inches fall hazard, on or about July 30, 2013. (b) 3rd Floor - Workers were sitting on an unguarded window opening ledge that was 23 inches above the floor surface, eating their lunch, and were exposed to a 26 feet 2 ½ inches fall hazard, on or about July 30, 2013. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
