5(a)(1) Violation Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to a caught in hazard while working directly behind a brush chipper. Employees while operating a Vermeer BC 1500 Brush Chipper were exposed to caught-in hazards while feeding branches and brush. Employees were manually feeding branches to the in-feed table standing directly behind the machine. Among other methods, the following are feasible and acceptable methods to correct this hazard. 1 - Conduct training for employees on the safe operating practices of the equipment in accordance with the manufacturer's instruction in the Vermeer BC 1500 Brush Chipper Operator's Manual and enforce those practices. 2 - Follow the standard of the American National Standards Institute Z133.1-2006, for Arboricultural Operations Safety Requirements. Section 8.6 addresses training that is to be provided in the proper operation, feeding, starting, and shutdown procedures for the chipper being used.
