29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person prior to the start of work, and as needed throughout the shift, for evidence of situations that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.   a) Inspections of the trench was not made by the competent person onsite and the employee entered an unprotected trench to install a new 6" water valve tap. The trench excavation was five feet and greater in depth and did not have the sidewalls sloped or benched, or have proective shielding in place such as a trench box installed to prevent trench sidewall(s) from potenetial collapse.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):   a) The employee entered an unprotected trench to install a new 6" water valve tap. The trench measured approximately 4' feet wide by 12' feet long and 8' feet and greater in depth with nearly vertical side walls. The employee was exposed to potential collapse of the unprotected side walls, in that sloping, benching, or a trench shielding methods were not implemented to prevent trench collapse potential(s).
