29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees.     On or about August 21, 2013, employees were exposed to struck-by hazards when working inside a trench measuring approximately 6 feet in depth and 36 inches in width which was provided with a ladder that was located more than 25 feet of lateral travel, from where employees were cleaning the trench for installing utility pipes.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:     On or about August 21, 2013, employees were exposed to a trench collapse, when working inside a trench greater than 5 feet in depth, outside the protective system, while cleaning up the bottom of the trench.     The Tri Star Utility, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 315630210, citation number 1, item number 1, and was affirmed as a final order on March 01,2012, with respect to a workplace located at 1818 Rogers, San Antonio, TX 78208.     The Tri Star Utility, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 314301813, citation number 1, item number 3a and was affirmed as a final order on 10/14/10, with respect to a workplace located at Austin Highway/Rainbow Dr., San Antonio, TX 78209.

29 CFR 1926.652(c)(1): Designs for aluminum hydraulic shoring shall be in accordance with paragraph (c)(2) or appendix D.    On or about August 21, 2013, employees were exposed to a trench collapse from an inappropriately positioned hydrualic cylinder that was placed above the trench wall, which does not distribute the force of the cylinder against a solid surface, while employees were cleaning up the bottom of the trench.      The Tri Star Utility, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(c)(1), which was contained in OSHA inspection number 314301813, citation number 1, item number 3b and was affirmed as a final order on 10/14/2010, with respect to a workplace located at Austin Highway and Rainbow Drive, San Antonio, TX.
