29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift. The employer does not ensure that a body belt with lanyard is attached to the boom while employee(s) worked from an aerial lift. This violation was observed on or about August 23, 2013, at a construction site where an employee was exposed to fall hazards when operating a Genie Aerial lift without wearing fall protection. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falling when working from an aerial lift.

29 CFR 1926.1053(b)(13): The top or step of a stepladder was used as a step. The employer does not ensure that the top step of a 6 foot ladder was not being used during an installation of outdoor lighting. This violation was observed on August 23, 2013, in the drive through area of the restaurant where an employee was exposed to fall hazards when installing outdoor lighting while standing on the top step of a Warner 6 foot aluminum ladder. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees do not use the top or step of a stepladder as a step.
