29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stair rail system along each unprotected side or edge: (a) Front of Building - Subcontractor workers were observed using a stairway with 5 risers to access the building that was missing a stair rail and exposed to an impalement hazard, on or about August 22, 2013. (b) 2nd Floor - Subcontractor workers were using a stairway with 16 risers to access their 3rd floor work area that was missing its stair rail on the unguarded open side, on or about August 22, 2013. For the purposes of this inspection, the employer was determined to be the controlling employer of the jobsite. The employer is being cited under OSHA's Multi-Employer Workplace Policy.

29 CFR 1926.1052(c)(12): Unprotected sides and edges of stairway landings were not provided with guardrail systems that meet the criteria contained in Subpart M of 29 CFR 1926: (a) Front of Building - Subcontractor's workers were observed using a stairway with 5 risers to access the building that had a landing with a guardrail system missing its mid-rail and the workers were exposed to an 8 feet fall hazard, on or about August 22, 2013. For the purposes of this inspection, the employer was determined to be the controlling employer of the jobsite. The employer is being cited under OSHA's Multi-Employer Workplace Policy.
