29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous At this job site, employees utilizing hand shovels working inside a 3 1/2 foott deep trench were not provided with gloves while using the shovels and handling rebar. Employees were exposed to cuts and lacerations.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents At this job site employees worked in a trench 3 1/2 foot deep using shovels to smooth the trench floor. The employees were not provided with safety glasses to prevent dirt particles from flying and striking the employees in the eyes as they shoveled the dirt onto the spoil pile.
