29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section. Excavation was not made entirely in stable rock and exceeded 5 foot in depth. a) On or about 08/26/13 CSHO observed a man working in a trench/excavation in excess of 5 foot deep with no protective system in place to protect him from cave-ins.
