29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee was not protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) 6th Street and Delancey Street - Employees replacing brick from a tubular welded frame scaffold were exposed to a fall hazard of approximately thirty-one (31) feet without the use of a personal fall arrest system or guardrail systems. Observed on or about August 27, 2013.

29 CFR 1926.451(e)(6)(vi): Integral prefabricated scaffold access frames did not have a maximum spacing between rungs of 16 3/4 inches (43 cm). Non-uniform rung spacing caused by joining end frames together is allowed, provided the spacing does not exceed 16 3/4 inches (43 cm). a) 6th and Delancey Street - Employees were not provided with a safe means of access and/or egress to the tubular welded frame scaffold platform, thus exposed to a fall hazard of approximately thirty-one (31) feet. The spacing between rungs was approximately 21 inches. Observed on or about August 27, 2013.
