29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section. a) Jobsite north trench: Employees who were excavating a trench to 5 ½ feet deep and were installing formwork for foundation concrete pouring, were not protected from cave-ins by an adequate protective system. A trench cave-in occurred and one employee was engulfed and trapped by soil. On or about 08/26/13. NOTE: IN ADDITION TO CERTIFICATION OF ABATEMENT, THE EMPLOYER IS REQUIRED TO SUBMIT DOCUMENTATION OF ABATEMENT FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
