29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): a) At the jobsite, inside the trench, on or about 8/26/13: Employees were working inside a trench with a measured depth of 5 and 6 feet, with vertically cut walls, and without a protective system to prevent cave in. Albert Torto Construction Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 314347204, citation number 01, item number 002 and was affirmed as a final order on 12/27/10, with respect to a workplace located at 3 Cleveland Avenue, Binghamton, NY.
