29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level: a) On August 23, 2013, and at times prior thereto, the employer did not ensure that its sub-contractor had protected its employees from fall hazards where window opening top rails were only 36 inches above walking/working levels. 29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. a) On August 23, 2013, and at times prior thereto, the employer did not ensure that its sub-contractor provided fall protection training to its employees. NOTE: Abatement certification IS required for this item.
