29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: (a) Jobsite: On or about August 21, 2013, the foreman did not remove two employees who were working an approximately 11 1/2 foot deep excavation that was not shored nor properly sloped. In addition, there were no soil tests conducted to determine the Class of soil that the employees were working in.
