29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace.    The employer does not medically evaluate the employee to determine the employee's ability to use a respirator.  This violation was observed on or about August 26, 2013 and at times prior thereto, at the mixing area, where employees were exposed to a respiratory hazard when wearing an N95 respirator without a medical evaluation to determine the employee's ability to use a respirator.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees that wear respirators are medically evaluated  to determine the employee's ability to use a respirator.
