OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards of falling from elevations which are causing or likely to cause death or serious physical harm to employees. This violation was observed on or about August 27, 2013 and at times prior thereto, in the cellar area, where employees were accessing and egressing the cellar pit by using folded stepladders that were leaning against the cellar walls. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the appropriate ladder is use for the task being performed.

29 CFR 1910.23(a)(5): Every pit and floor opening was not adequately guarded by standard railing or any other effected means. The employer does not adequately guard every pit opening. This violation was observed on or about August 27, 2013, at the cellar area where employees were exposed to a fall hazard when walking around the cellar pit without the cellar pit being adequately guarded. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falling into unguarded pits.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace. The employer does not medically evaluate the employee to determine the employee's ability to use a respirator. This violation was observed on or about August 27, 2013 and at times prior thereto, at the mixing area, where employees were exposed to a respiratory hazards when wearing an N95 respirator without a medical evaluation. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees that wear respirators are medically evaluated to determine the employee's ability to use a respirator before being fit tested.
