OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer does not furnish to each of his employees employment and a place of employment which are free from the recognized hazards of falling from elevations which are causing or likely to cause death or serious physical harm to employees. This violation was observed on or about August 27, 2013 and at times prior thereto, in the cellar area, where employees were accessing and egressing the cellar pit by using folded stepladders that were leaning against the cellar walls.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the appropriate ladder is use for the task being performed.
