29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.    a.  The employer did not have a lock out/tag out program for employees who serviced and operated equipment that included (but was not limited to) heated molds, vacuum formers, vertical band saws and table saws.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.    a.  At the work site, employees used a grey SCMI SC 900 band saw, serial number 02/2436 to cut apart plastic parts and to saw surplus materials into smaller parts for recycling.  The employer had failed to guard the saw at the point of operation to prevent employee exposure to the moving blade.    b.  At the work site, employees used a green SCMI SC 900 band saw, serial number 1594 to cut apart plastic parts and to saw surplus materials into smaller parts for recycling.  The employer had failed to guard the saw at the point of operation to prevent employee exposure to the moving blade.    c.  At the work site, employees used a grey SCMI SC 600 band saw, serial number 803 to cut apart plastic parts and to saw surplus materials into smaller parts for recycling.  The employer had failed to guard the saw at the point of operation to prevent employee exposure to the moving blade.    d.  At the work site, employees used a grey SCMI SC 600 band saw, serial number 621 to cut apart plastic parts and to saw surplus materials into smaller parts for recycling.  The employer had failed to guard the saw at the point of operation to prevent employee exposure to the moving blade.

29 CFR 1910.213(h)(1): The upper hood shall completely enclose the upper portion of the blade down to a point that will include the end of the saw arbor. The upper hood shall be constructed in such a manner and of such material that it will protect the operator from flying splinters, broken saw teeth, etc., and will deflect sawdust away from the operator. The sides of the lower exposed portion of the blade shall be guarded to the full diameter of the blade by a device that will automatically adjust itself to the thickness of the stock and remain in contact with stock being cut to give maximum protection possible for the operation being performed.    a.  At the work site, employees used a Delta ShopMaster table saw to cut wood templates for various areas in the shop.  The employer had not ensured the saw was adequately guarded to prevent employee exposure to the moving blade.

29 CFR 1910.1200(e)(1):   Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  a.  At the work site, employees used propane-powered fork lifts, commercial glues, commercial glue remover and various types of plastics.  The employer did not have a written hazard communication program for employees that included hazardous materials which included, but were not limited to, propane and Green-Kleen glue remover.

29 CFR 1910.1200(h)(1):     Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.    a.  At the work site, employees used chemicals that included, but were not limited to, propane tanks for the fork lift trucks, industrial glue, and plastics that were heated.  The employer did not have a hazard communication training program for employees.
