29 CFR 1910.334(a)(2)(ii): There was a defect or evidence of damage that could have exposed an employee to injury and the defective or damaged item was not removed from service and an employee was using it before repairs and tests necessary to render the equipment safe were made: On or about August 28, 2013 an orange extension cord was used to operate a Port-A-Cool fan (36" 3-SPEED PORT-A-COOL, PAC2K363S) in the warehouse. The extension cord sheathing and insulation was cut and had protruding copper wires with blue painters tape over it and was left to run continuously during working hours, exposing employees to an electrical shock hazard.
