29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)     a) At the site, on or about 08/28/2013, the employer had not devloped and implemented a hazard communication program. Employees were using hazardous chemicals such as, but not limited to, Mule-Hide Tape Primer, containing acetone and toluene, while performing trailer construction work.  Acetone and toluene are absorption and inhalation hazards.

29 CFR 1910.1200(g)(1): The employer did not have a material safety data sheet for each hazardous chemical in use: (Construction Reference: 1926.59)    a) At the worksite, on or about 08/28/2013, the employer did not have a material safety data sheet for Mule-Hide Tape Primer, containing toluene and acetone. Employees were applying this substance to the seams of the building. Toluene and acetone are absorption and inhalation hazards.      b) At the worksite, on or about 08/28/2013, the employer did not have a material safety data sheet for Henry 331 Super Patch Latex Floor Patching, containing silica. Silica is an inhalation hazard.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)      a) At the worksite, on or about 08/23/2013, employees were applying Mule-Hide Tape Primer, containing acetone and toluene, to the seams of the building. Acetone and toluene are absorption and inhalation hazards. Employees had not received information on the requirements of 29 CFR 1910.1200; operations in their work area where hazardous chemicals are present; and the location and availability of the written hazard communication program, including the material safety data sheets. Employees had not been trained on the methods and observations used to identify the presence or release of hazardous chemicals in the work area; protective measures; and the details of the employer's written hazard communication program, including an explanation of the material safety data sheet.
