29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  a.  On or about August 27, 2013, at the above addressed job site, employees were exposed to a fall hazard while applying waterproofing on a wall of a third floor balcony without using a conventional fall protection system.   b.  On or about August 27, 2013, at the above addressed job site, employees were exposed to a fall hazard while applying waterproofing on a wall of a second floor balcony without using a conventional fall protection system.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a. On or about August 27, 2013, at the above addressed job site, employees were exposed to a fall hazard while using a ladder that did not extend 3 feet above a 3rd floor balcony.

29 CFR 1926.1053(b)(8): Ladders placed in a location where they could be displaced by workplace activities or traffic, such as in passageways, doorways, or driveways, were not secured to prevent accidental displacement, nor was a barricade used to keep the activities or traffic away from the ladder:  a. On or about August 27, 2013, at the above addressed job site, the employer did not secure an extension ladder used by employees to gain access to the 2nd and 3rd story balconies to prevent accidental displacement.
