29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation: On or about August 29, 2013, at the above addressed worksite, an employee was working in an excavatoin in which water had accumulated. The accumulated water can cause the walls to deteriorate at the base of the wall which leads to a cave-in of the trench and the employee being engulfed.

29 CFR 1926.651(i)(1): Where the stability of adjoining buildings, walls, or other structures was endangered by excavation operations, support systems such as shoring, bracing or underpinning was not provided to ensure the stability of such structures for the protection of employees: On or about August 8, 2013, at the above addressed jobsite, an electric utility pole at the edge of the excavation was not supported to prevent the pole from falling and bringing down live electrical wires that could lead to electrocution of nearby employees.
