29 CFR 1910.213(i)(1): All portions of the saw blade shall be enclosed or guarded, except for the working portion of the blade between the bottom of the guide rolls and the table. Bandsaw wheels shall be fully encased. The outside periphery of the enclosure shall be solid. The front and back of the band wheels shall be either enclosed by solid material or by wire mesh or perforated metal. Such mesh or perforated metal shall be not less than 0.037 inch (U.S. Gage No. 20), and the openings shall be not greater than three-eighths inch. Solid material used for this purpose shall be of an equivalent strength and firmness. The guard for the portion of the blade between the sliding guide and the upper-saw-wheel guard shall protect the saw blade at the front and outer side. This portion of the guard shall be self-adjusting to raise and lower with the guide. The upper-wheel guard shall be made to conform to the travel of the saw on the wheel. a) On or about 08/28/13, in the crate room, an Oliver 388 Vertical Band Saw did not have guards on the non-working part of the blade under the table and on the side of the table. b) On or about 08/28/13, in the crate room, an Oliver 388 Vertical Band Saw 's top wheel wire mesh guard openings were one (1) inch instead of not greater than three-eighths (3/8) inch. ABATEMENT CERTIFICATION REQUIRED

There was not an adjustable tongue guard. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1904.4(a): The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent. Located at the Neville Manufacturing, Service & Distribution, Inc Company, Cheektowaga, NY, USA: On or about 08/28/13, the employer did not record the following workplace injuries on the OSHA 300 log for calendar year 2012. a) On or about 09/17/12, a Laborer was flipping pallets and felt discomfort. Employee was on job restriction for three days. b) On or about 12/10/12, a Laborer suffered a laceration on his right pinky that required sutures and two days away from work. c) On or about 10/29/12, a Laborer suffered a laceration on his left middle finger that required sutures. d) On or about 04/16/12, a Laborer got hit by a lumber to the groin and he received sutures. e) On or about 04/12/12, a Laborer hit his head and received medical treatment beyond first aid. f) On or about 02/23/12, a Laborer was struck by a lumber in his left leg, received medical treatment and job restriction for 7 days. NO ABATEMENT CERTIFICATION REQUIRED
