29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: On or about August 29, 2013 and times prior thereto, employees of Harper Layne Builders, LLC. performed framing activities on the roof of a one story residence being constructed at or near 185 Waverly Circle in El Dorado, Arkansas. Employees were observed framing the 8:12 pitch steep sloped roof top without the use of fall protection, exposing them to fall distances of greater than 6 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: On or about August 29, 2013 and times prior thereto, employees of Harper Layne Builders, LLC. performed framing on the rooftop of a one story residence being constructed at or near 185 Waverly Circle in El Dorado, Arkansas. The employer had not provided a training program for employees exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed to minimize fall hazards.
