OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Rick Weaver Buick GMC, Inc / 1128 West 12th Street, Erie, PA: On or about August 30, 2013 employees were potentially exposed to fall hazards from the improper use of portable composite fiberglass step ladders. An employee utilized the top step of the step-ladder to access the facility's roof.

29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet (1.22 m) or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides: a) Rick Weaver Buick GMC, Inc. / 1128 West 12th Street, Erie, PA: On or about August 30, 2013 an employee was potentially exposed to a fall hazard of at least 8-feet (ground to eave height). The employee was spraying an instant leak sealer on various areas of a metal sloped roof. The employee was not protected from falling by guardrails and/or equivalent protection. IN THE ALTERNATIVE: 29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered. a) Rick Weaver Buick GMC, Inc. / 1128 West 12th Street, Erie, PA: On or about August 30, 2013 an employee was potentially exposed to a fall hazard of at least 8-feet (ground to eave height). The employee was spraying an instant leak sealer on various areas of a metal sloped roof. The employee was not wearing and/or utilizing a personal fall arrest system (PFAS) while performing the activities related to spraying a leak sealer on the roof.
