29 CFR 1904.39(b)(5): The employer did not report a heart attack that occurred at the workplace within 8 hours. a. On or about August 17, 2013, the employer failed to inform OSHA within 8 hours after the death of one of their employees from a heart attack. The employer was advised of the victim's death at approximately 11:00pm EST on August 17, 2013, and OSHA was notified by legal counsel representing the victim's family at approximately 12:15pm EST on August 29, 2013.
