On or about August 21, 2013, northeast side of the building, the second and third levels of the scaffold were not fully planked, exposing employees of Avery Enterprises, Inc., to a 20 feet fall hazard. b. On or about August 21, 2013, north side of the building, the third level of the scaffold was not fully planked, exposing employees of Midstate Caulking & Construction Services, Inc. to a 14 feet fall hazard. 29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level: a. On or about August 21, 2013, northeast side of the building, two employees of Avery Enterprises, Inc. were cutting and installing tiles from the top level of a 3 buck high scaffold system. They were not protected from falling 20 feet by the use of a guadrail system, safety net system or personal fall arrest system. b. On or about August 21, 2013, north side of the building, employees of Midstate Caulking & Construction Services, Inc. were plastering the exterior of the building. They were not protected from falling 14 feet by the use of a guardrail system, safety net system or personal fall arrest system. Abatement Certification and Documentation are not required
