29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition. A) By loading dock, on or about August 30, 2013, Yale forklifts #52, #67, and #69 did not have a functioning parking brake, exposing employees to a struck by hazard. B) By loading dock on or about August 30, 2013, Yale forklift #52, did not have a functioning horn on or near the steering wheel, exposing employees to a struck by hazard. C) By loading dock, on or about August 30, 2013, Yale forklift #52, had a broken rear tail light and forklift #67 did not have functioning head lights, exposing employees to a struck by hazard.
