29 CFR 1910.1030(f)(5): The employer did not obtain or provide the employee with a copy of the evaluating health care professional's written opinion within 15 days of the completion of the evaluation: a) Aria Health (Frankford): An employee (Nurse) contracted Hepatitis C after sustaining a needlestick injury to the right index finger while attempting to insert an intravenous device into a patient's arm. The employer did not ensure that the employee was provided with the evaluating healthcare professional's written opinion within fifteen (15) days of the completion of the medical evaluation. On or about April 4, 2013. Abatement Note: The evaluating healthcare professional's written opinion needs to include: a) Whether the Hepatitis B vaccination is indicated for the employee, and if the employee received the vaccination; and b) That the employee has been informed of the results of the evaluation and told about any medical conditions resulting from exposure to blood or other potentially infectious materials requiring further evaluation or treatment.

29 CFR 1910.1020(g)(1)(iii): Employees were not informed upon first entering into employment and/or at least annually thereafter of their right to access their medical and/or exposure records: a) Aria Health (Frankford): An employee (Nurse) contracted Hepatitis C after sustaining a needlestick injury to the right index finger while attempting to insert an intravenous device into a patient's arm. The employee was never provided training concerning the employee's rights of access to employee medical and exposure records. On or about April 4, 2013. Abatement Note: 1. Employee exposure records include: a) Environmental (workplace) monitoring or measuring of a toxic substance or harmful physical agent, including personal, area, grab, wipe, or other form of sampling, as well as related collection and analytical methodologies, calculations and other background data relevant to the interpretation of the results obtained; and b) Biological monitoring results which directly assess the absorption of a toxic substance or harmful physical agent by body systems. 2. Employee medical records means a record containing the health status of an employee which is made or maintained by a physician, nurse, or other healthcare personnel, or technician, including: a) Medical and employment questionnaires or histories; b) The results of medical examinations and laboratory tests; c) Medical opinions, diagnoses, progress notes, and recommendations; d) First aid records; e) Descriptions of treatments and prescriptions; and f) Employee medical complaints. 3. Training concerning the employee's rights of access to records shall be provided upon an employees first entering into employment, and at least annually thereafter.

29 CFR 1910.1030(h)(5)(i)(A): The employer did not maintain a sharps injury log that contained, at a minimum, the type and brand of device involved in the incident: a) Aria Health (Frankford): An employee (Nurse) contracted Hepatitis C after sustaining a needlestick injury to the right index finger while attempting to insert an intravenous device into a patient's arm. The employer did not ensure that the sharps injury log included the type and brand of the device that was used by the exposed employee during the exposure incident. On or about April 4, 2013. b) Aria Health (Frankford): Employees sustained needlestick injuries on May 5, 2013, May 6, 2013 and June 13, 2013. The employer did not ensure that the sharps injury log included the type and brand of the device that was used by the exposed employees during the exposure incidents. On or about September 26, 2013. Abatement Note: The sharps injury log shall contain, at a minimum: a) The type and brand of device involved in the incident b) The department or work area where the exposure incident occurred, and c) An explanation of how the incident occurred.
