29 CFR 1910.67(c)(2)(v): A body belt was not worn and a lanyard attached to the boom or basket when working from an aerial lift.  The employer does not protect employees from being ejected when working from an aerial lift. This violation was observed at the construction site on August 28, 2013 where an employee without a body harness and lanyard was exposed to fall of 30 ft. when performing work from an aerial lift.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees working from an aerial lift are protected from being ejected.

29 CFR 1910.135(a)(1): The employer shall ensure that each affected employee wears a protective helmet when working in areas where there is a potential for injury to the head from falling objects.  The employer does not ensure that each employee is protected from injuries to the head from falling objects.  This violation was observed on or about August 28, 2013, where employees were exposed to a struck-by hazard when working under the basket of an elevated aerial lift without wearing hardhat.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from head injuries from falling objects.
