29 CFR 1926.1437(h)(1): When using a land crane on a barge: The employer did not inspect each workshift to ensure that the means used to secure/attach the crane to the vessel is in proper condition: a) An inspection of the crane curb system was not provided: the employer was using a 150 ton American 9280 crawler crane on the Mia Forte barge in the East River. One of the steel I-beam crane curbs was not welded or otherwise secured to the barge, and was positioned at the edge of the crane pad where it can tip over onto employees working on the barge. Location: East River at 38th street, New York, N.Y. On or about 8/27/2013 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1437(n)(5): The crane was not secured from movement on a floating barge by one of the following methods: Option (1) physical attachment Option (2) corralling Option (3) rail system Option (4) centerline cable system a) A 150 ton American 9280 crawler crane was being used on the Mia Forte barge in the East River, NYC: There were two steel I-beams being used as crane curbs (Option 2 corralling). The curbs were only on one side of the crane and one of the curb I-beams was not secured to the barge deck. A completed crane curb system was not provided. Location: East River at 38th street, New York, N.Y. On or about 8/27/2013 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

Only two I-beams curbs were provided which was not enough to surround/ corral the crane. One I-beam was not welded or otherwise secured to the barge.
