29 CFR 1910.178(l)(3)(i)(C): Powered industrial truck operators were not trained in the following topics; truck controls and instrumentation, where they are located, what they do, and how they work: The employer does not ensure that power industrial truck operators were trained in truck controls and instrumentation, where they are located and what they do and how they work. This violation occurred on or about August 27, 2013, at the McCoy's Building Supply where power industrial truck operators were exposed to caught in/between hazards when operating a forklift without being trained on truck controls and how they work with regards to the parking brake system and how to adjust the brake if needed. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that operators are trained regarding truck controls and instrumentation, where they are located, what they do, and how they work.

29 CFR 1910.178(m)(5)(iii): Powered industrial truck(s), with the operator dismounted and within 25 feet of the truck still in his view, did not have the load engaging means fully lowered. The employer does not ensure that the operator of a powered industrial truck who is dismounted and within 25 feet of the truck have the load engaging means fully lowered. This violation occurred on or about August 27, 2013, in McCoy's Building Supply, where a forklift operator was exposed to caught in/between hazards when he dismounted from the forklift without fully lowering the load engaging means. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the load engaging means is fully lowered when the operator is dismounted and within 25 feet of the truck and still in view.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition. The employer does not ensure that powered industrial trucks found to be in need of repair, defective, or in any way unsafe were taken out of service. This violation occurred on or about August 27, 2013 and at times prior thereto, at McCoy's Building Supply where operators were exposed to harzrds in need of repair and was not taken out of service until restored to a safe operatin condition. Specifically, strobe and brake lights were indicated not working, and the overhead guard had what appeared to be cracks on the carriage. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that power industrial trucks found to be in need of repair, defective, or in any way unsafe will be taken out of service until restored to safe operating condition.
