Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of getting struck-by traveling mobile cranes: (a) Open Lot on the West Side of the Cylinder Building - The employer did not ensure that employees involved in repositioning mobile wheel-mounted hydraulic cranes stood clear of the struck-by hazard created by traveling cranes, resulting in the death of an employee who got struck-by and pinched between the rearward starboard side of a traveling TMS9000E mobile wheel-mounted hydraulic crane and the front port side of a parked RT530E-2 mobile rough-terrain wheel-mounted hydraulic crane, on or about August 29, 2013. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
