OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to laceration hazards due to improperly designed and maintained machine tool foot treadles: a) Rear Room - The foot pedal on the Sampson Metal Cutter Machine was not guarded and had a damaged air control valve which prevented proper system cycling and did not preclude inadvertent operation, on or about 8/27/13. Among other methods, one feasible means of abatement would be to guard and repair the foot pedal to proper working order in accordance with paragraph 4.2.3.2 of ANSI B11.10, "Safety Requirements for Construction, Care, and Use of Metal Sawing Machines".
