OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: Work place: Employees were not prohibited from using a 10-foot fiberglass stepladder that was equipped with a damaged and a missing horizontal braces. The ladder was not taken out of service or marked and/or tagged in a manner, "Do Not Use". On July 25, 2013, the above ladder was displaced while an employee was using it, and the employee sustained severe injuries from the incident.
