29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided: a- 200 Portland Road, Building E, Highlands NJ: On or about 08/22/13, employees performing shingle rip, tear, replace, and other related activities (from a shed roof whose eave was approximately 12 feet 2 inches to the ground surface below) was exposed to fall hazards when they were not provided with a Personal Fall Arrest System, Safety nets, guard rails, etc. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii): a- 200 Portland Road, Building E, Highlands NJ: On or about 08/22/13 employees, not supplied with fall protection, were performing shingle rip, tear, replace, and other related activities from a shed roof whose eave was approximately 12 feet 2 inches to the ground below. Company employees at the worksite had not received fall protection training from a competent person. IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
