On or about 8/22/2013, the owner of H & J Kendal Guaranteed Home Remodeling, Joe Kendal, and one of his employees were not wearing eye protection while using pneumatic nailers on a residential building located at 307 Katy Trail Lane, St. Charles MO 63303.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. On or about 8/22/2013, the owner of H & J Kendal Guaranteed Home Remodeling, Joe Kendal, the crew leader, Matthew Dodd, and six employees were working on the roof an apartment building, which was approximately 24 feet above the ground, without the use of guardrail systems, safety net systems, or personal fall arrest systems.
