29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:     a) On or about September 10,2013, Oasis Plumbing Company Inc. did not ensure that each employee in an excavation was protected from cave-in hazards. Employer did not use an adequate protective system in accordance with OSHA 1926.652(c) standards. One employee was observed repairing a sewer line in an unprotected vertically sided trench, which measured depth was 8.0 feet , 4 feet wide, and approximately 13 feet long. This condition exposed the employee to a crushing hazard by trench wall cave-in.                           Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").       The employer Oasis Plumbing Company Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 311908164, citation      number 1, item number 2b and was affirmed as a final order on November 3,2008, with respect to a workplace located at 8641 Rosemary Street, Commerce City, CO 80022.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:      a) On or about September 10, 2013, Oasis Plumbing Company Inc. did not ensure that the loose soil from an excavation was kept at least 2 feet away from the edge of the excavation to prevent the falling or rolling of such soil into the trench. An employee was observed working in an unprotected vertically-walled trench while repairing a sewer line at a depth of 8.0 ft.   The spoil pile was immediately next to the edge of the trench, this condition exposed the employee to the hazards of the spoil pile falling or rolling into the trench.
