29 CFR 1910.23(c)(3): Regardless of height, open-sided floors, walkways, platforms, or runways above or adjacent to dangerous equipment, pickling or galvanizing tanks, degreasing units, and similar hazards were not guarded with a standard railing and toe board.    a)      On or about September 12, 2013, the employer did not assure that the platform used to bridge the acid tanks was equipped with a standard railing and toe board.  Employees perform work from the platform when necessary.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:      a)  On or about September 12, 2013, the employer did not assure that employees received a medical evaluation prior to requiring the use of a respirator.  Employees were utilizing a North half-face cartridge style respirator to protect them from being potentially exposed to acids mists while working over the acid tanks.  A respirator can place a burden on an employee's cardiovascular and respiratory systems.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:      a)      On or about September 12, 2013, the employer did not develop and implement a written respiratory protection program to address the selection, maintenance, storage, and use of respirators. Employees performing work over the acid tanks were required to wear a North half-mask tight-fitting respirator equipped with organic vapor cartridges.

29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or  were not packed or stored to prevent deformation of the facepiece and exhalation valve:    a)       On or about September 12, 2013, the employer did not assure that employees stored their tight-fitting respirators to prevent damage to the face piece and prevent contamination.  Employees kept their respirators in a storage cabinet but the respirators were not protected from deformation, and contamination, such as dust, dirt, and acid residue.
