29 CFR 1910.134(c)(2)(i): An employer provided respirators at the request of employees or permitted employees to use their own respirators, if the employer determined that such respirator use will not in itself create a hazard. If the employer determined that any voluntary respirator use is permissible, the employer did not provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard"):  a). On or about 9/11/13, at 329 Glenmont Road, Glenmont, NY 12077, the employer provided SAS 8610 N95 to employees without providing an Appendix D and or information contained in the Appendix D.

The employer did not provide training to include how employees could protect themselves from silica dust and the physical and health hazards associated with silica dust.
