OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard while performing material handling activities in the cold storage warehouse: a) Cold storage warehouse: On September 11, 2013 and at times prior thereto the industrial storage rack system in use was not inspected and maintained. Safety bolts or other safety devices on the beams were either not in place or were not positively engaged with the supporting upright columns to prevent dislodging of the beams. Note) Abatement certification IS required for this item.
