OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. The employer failed to ensure that a warehouse employee being elevated by a forklift was protected by using an approved work platform. a) Box 4, North Side Building - The employer did not provide safe access to elevated levels of warehouse storage racks. An employee accessed the second level of a storage rack by being lifted on the forks of a fork truck. The employee was exposed to a fall hazard of approximately 8'6". On or about 09/07/2013.

29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. The railing shall be provided with a toeboard wherever, beneath the open sides, a) Box 4, North Side Building - An employee was standing on a pallet at the second level of a warehouse storage rack. The employee was not protected from falling to the warehouse floor. The employee was exposed to a fall of approximately 8'6". On or about 09/07/2013. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
