29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under � 1926.502(e). (a) 2578 Hempstead Turnpike, East Meadow, Ny (Worksite), north side of building, facade - An employee was operating the Versalift Aerial Lift, Model # TEL29EGA / Serial # F191182, at a height of 18'-3", without fall protection on, or about September 12, 2013. (b) (Worksite), north side of building, facade - An employee was operating the Versalift Aerial Lift, Model # TEL29EGA / Serial # F190201, at a height of 23'-6", without fall protection on, or about September 12, 2013. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this violation in accordance with 29 CFR 1903.19.

(a) Worksite, north side of building, facade - An employee was not trained to recognize the hazards; or in the methods to control or minimize the hazards associated with operating the Versalift Aerial Lift, Model # TEL29EGA / Serial # F191182, on, or about September 12, 2013. Note: The employer is required to submit abatement certification for this violation in accordance with 29 CFR 1903.19.
