29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: (a) A competent person did not inspect the mound of soil to insure that a safe means was available and used to move the excavator to the top where it could be use to load trucks. (b) A competent person did not inspect the work practices of drivers to insure that they tarped their loads prior to moving them. and (c) A competent person did not observe the work practices of operators to insure that they used their seat belts when operating heavy equipment.

29 CFR 1926.602(a)(3)(i): The employer moved or caused to be moved construction equipment or vehicles upon an access roadway or grade without ensuring tje access roadway or grade was constructed and maintained to safety accommodate the movement of equipment and vehicles. (a) An employee moved an excavator on a grade that had not been compressed to ensure stability for the excavator to operate. The excavator rolled over trapping the operator underneath.
