29 CFR 1910.243(c)(3): Abrasive wheels used on vertical portable grinder(s) (right angle head grinders) were not provided with safety guard(s) having a maximum exposure angle of 180 degrees and located between the operator and wheel.    On or about September 13th 2013, the employer failed to ensure that the angle grinders being used were equipped with safety guards. The grinders were being used in the welding area of the shop to grind metal so that is has a clean surface on which to weld.

29 CFR 1910.253(e)(1): Equipment was not installed and used only in the service for which it was approved and as recommended by the manufacturer.    On or about September 13th, 2013, in the welding and cutting area of the shop, the employer failed to ensure that the pressure regulator on a propane cylinder was properly maintained. The glass covering that protects the gauges in the regulator was missing. The propane cylinder was used as the fuel gas for an oxygen-fuel gas cutting torch.

29 CFR 1910.303(b)(1): Electrical equipment was not free from recognized hazards that were likely to cause death or serious physical harm to employees.    On or about September 13th 2013, the employer failed to ensure that the wiring that existed in the shop building was free from recognized hazards. The lighting in the building was wired with extension cords that were spliced, taped and had exposed inner conductors.

On or about September 13 2013, the employer failed to ensure power (on/off) switches were installed for the lighting used in the welding shop. Circuit breaker 37 in the shop's panel box was being used as the power switch for the lighting.

29 CFR 1910.334(a)(2)(ii): There was a defect or evidence of damage that could have exposed an employee to injury and the defective or damaged item was not removed from service:    On or about September 13th 2013, in the welding shop area, the employer failed to ensure that damaged electrical extension cords were removed from service. An extension cord had a four inch section of the outer sheath missing which exposed the inner conductors.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not conducted at least once every three years.  On or about September 13th 2013, the employer failed to ensure that the forklift operator, Flint Broom, had his forklift certification reevaluated. The certifcation the employee had on site had been issued in 2004 and the employee had not had any training or evaluation since being issued the certification in 2004.
