29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): (a) Warehouse - The employer did not provide training on powered industrial trucks as required by the standard to permanent and temporary employees, and the employer permitted these employees to operate the Yale sit-down rider forklift, model ERC040ZGN48TO084, serial number E108V16261Y, exposing employees to hazards including, but not limited to, tipping of the forklift. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.178(o)(1): Loads which were not stable or safely arranged were handled: (a) Warehouse - An employee travelled with the Yale sit-down rider forklift, model ERC040ZGN48TO084, serial number E108V16261Y, equipped with a clamp attachment, with the forks in an almost fully elevated position rather than in a lowered position, and the forklift did tip forward, causing battery acid to spill out and causing the employee to suffer a contusion to the right knee, on or about September 12, 2013. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
