OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to a struck-by hazard: On or about September 16, 2013, at the above addressed jobsite, a valve tipped over, struck and crushed an employee while he was wiping the surface of the valve edge.

29 CFR 1926.250(b)(9): Cylindrical materials were not stacked and blocked so as to prevent spreading or tilting: a. On or about September 16, 2013, at the above addressed jobsite, employees were exposed to a crushed-by hazard due to an improperly stored water valve that was not blocked to prevent tilting. b. On or about September 16, 2013, at the above addressed jobsite, an employee was crushed by a valve that was not sufficiently blocked to prevent it from tilting while he was wiping the surface of the valves edge.
