Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee involved in surveying activities in the center of the intersection and exposed to the hazard of being struck by vehicles. a) 6th Ave E and Ketchum St. E, middle of intersection; On or about September 11, 2013, and at times prior thereto, the employer did not provide traffic control/protection for an employee performing surveying activities in the middle of an active high volume intersection to locate and uncover the survey marker. b) 6th Ave E and Ketchum St., E, middle of intersection; On or about September 11, 2013, and at times prior thereto, the employer did not have advance warning signs established to alert traffic well in advance of road obstructions and/or restrictions. Note: Abatement and certification documentation ARE required for this item.

This exposed employee to the hazard of falling off and being struck by vehicles . a) 6th Ave N and Shoshone St. N; On or about September 11, 2013, and at times prior thereto, an employee was observed riding on a makeshift work platform attached to the hitch of the work truck that was not equipped with a hand hold bar and exposed to the hazard of falling and/or being struck by traffic Note: Abatement and certification documentation ARE required for this item.
